Terms and Conditions

This English translation is provided for convenience. The version in the shop’s own language is the legally binding one.

Art. 1 Scope, contracting party

(1) These terms apply to all orders placed via the Paveikslai online shops. Your contracting party is:

(2) A consumer is any natural person acting for purposes outside their trade or profession.

(3) Deviating terms of the customer are not recognised unless we expressly agree to them in writing.

Art. 2 Conclusion of the contract

(1) The presentation of artworks in the shop is not a legally binding offer but an invitation to order.

(2) You can place artworks in the cart and correct all entries before submitting. By clicking the order button with the payment obligation, you make a binding offer to conclude a purchase contract.

(3) We confirm receipt of your order without delay by e-mail. For card, Apple Pay, Google Pay, PayPal or Klarna payments the contract is concluded upon completion of the payment; for prepayment by bank transfer, upon our order confirmation and at the latest upon receipt of payment.

(4) The contract text is stored by us. The order data, these terms and the withdrawal information are sent to you by e-mail.

Art. 3 Artworks, availability, colour variations

(1) We sell original artworks (one-off pieces) — painting, graphic art, photography and other techniques. Each work exists only once.

(2) The artworks are offered in parallel in our galleries in Lithuania. Should a work exceptionally already be sold or firmly reserved when your order arrives, we will inform you without delay; payments already made will be refunded without delay.

(3) Minor colour and contrast deviations from the screen display are of a technical nature and do not constitute a defect, insofar as they are customary and acceptable.

(4) Stated dimensions refer to the artwork; for framed works the outer dimension may vary with the frame profile.

Art. 4 Prices and shipping costs

(1) All prices are final prices in euros, including the statutory VAT of the country of delivery.

(2) Shipping costs apply in addition and are shown on the delivery page and during checkout before the order is placed.

Art. 5 Payment

The payment methods shown during checkout are available: credit/debit card, Apple Pay, Google Pay, PayPal, Klarna and prepayment by bank transfer. For prepayment, the price is due within 5 days of ordering; dispatch follows receipt of payment.

Art. 6 Delivery, delivery time

(1) The delivery time is 10–14 business days from conclusion of the contract (for prepayment, from receipt of payment): careful packing of the one-off piece plus shipping time.

(2) Shipping is by courier (e.g. FedEx/DHL), insured and with tracking.

(3) For consumers, the risk of loss or damage passes upon handover of the work to you.

(4) If a work is not available, we will inform you without delay. If delivery is permanently impossible, payments already made will be refunded without delay.

(5) Please report visible transport damage to the courier and inform us. This is not a condition of your statutory rights.

Art. 7 Retention of title

The work remains our property until paid in full.

Art. 8 Right of withdrawal

Consumers have a statutory right of withdrawal of fourteen days. Details and the model form are in the withdrawal notice. The right does not apply to individually commissioned works (Art. 16(c) of Directive 2011/83/EU); we point this out separately before the order is completed. Original artworks from our catalogue are not excluded.

Art. 9 Statutory warranties

(1) The statutory conformity rules apply — within the EU at least two years from delivery; longer periods may apply in some countries.

(2) A commercial guarantee beyond that is granted only where expressly stated.

Art. 10 Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory product liability law.

(2) For slight negligence we are liable only for the breach of essential contractual obligations, limited to the foreseeable damage typical of the contract.

(3) Otherwise liability is excluded. Mandatory consumer rights remain unaffected.

Art. 11 Gift vouchers

Gift vouchers can be redeemed for any artwork in the shop. Cash payment is excluded. The validity period is stated on the voucher.

Art. 12 Copyright

By purchasing an artwork you acquire ownership of the original. Copyright (including reproduction and public communication) remains with the respective artist. Our product photos, texts and the shop design are protected by copyright.

Art. 13 Governing law, final provisions

(1) The governing law is stated in the shop-language version of these terms, which prevails over this translation. The choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence (Art. 6(2) Rome I Regulation).

(2) Should individual provisions be invalid, the validity of the remaining provisions is unaffected.
